Target group
This training is suitable for Belgian business managers, members of the board, HR-managers, salary administrators, who employ staff in Belgium.
ObjectiveThe course consists of an interactive training, in which the subject matter is clarified with real-life examples.
You would like to have an understanding of Belgian labour (social) law: what are the rights and obligations of Belgian employees and employers?
This training will provide you with the necessary knowledge in order to provide you with the correct and practical answers to questions of your employees related to labour law.
The whole track from recruitment to dismissal will be treated from a socio-judicial point of view.
Programme
In Belgium employer and employee are bound together by a special kind of agreement, the individual labour contract. The relationship between employer and employee is regulated in detail by law.
Typically Belgian, for example, is the difference between blue collar and white collar workers and also the different official languages, which makes Belgian labour law more complicated in comparison to other countries.
The purpose of this training is to describe the basic principles of Belgian labour law. During the training, theory and practice will be combined.
Start of employment
- Hiring of foreign employees and the application of a work permit, international secondments
- Different types of Belgian employment contracts, such as permanent contracts, fixed term contract, student employment contracts, specific contract clauses
- The difference between blue collar and white collar workers
- Trial period: minimum and maximum duration are set by law. Is a succession of fixed term contracts possible?
Active employment
- Salary and other employee benefitWorking times: legal rules regarding normal weekly and daily working time, overtime payment, working on Holiday
- Suspension of the contract: pregnancy and maternity leave, illness, annual vacation, career interruption
Termination of an employment contract
- Mutual agreement
- Dismissal by the employer: notice period and severance payment
- Resignation by the employee
- Termination for gross misconduct
Use of language in social relations
Which national languages have to be used in official social communication between employer and employee? Sanctions?

Social consultation happens at different levels:
- national level – Collective Labour Agreements
- sectoral level
- company level: the main differences between the Works counsil, the Committee for Prevention and Protection at work and the Union Delegation
